Onus on Zuma to prove Zondo appointment was unlawful - expert

A legal expert says the
onus is on the Jacob Zuma Foundation to provide concrete evidence supporting
its claim in challenging the appointment of Chief Justice Raymond Zondo.

The foundation wants to set aside a 2022 decision by President Cyril Ramaphosa to appoint Zondo as chief justice.
Zuma's foundation claims Zondo received the lowest score from the Judicial Service Commission following extensive interviews.
The president has already indicated it would be opposing the application.

Law expert Sunil Singh says if Ramaphosa disregarded the JSC recommendations, the foundation may have a strong case.
"Unless Jacob Zuma Foundation has sufficient and cogent reasons as to why that appointment should not be made they can lodge an application to the court to say the appointment is irregular and based on the ground of the legitimate or illegitimate appointment of the chief justice."
Singh believes the matter is likely to end up at the Constitutional Court.
