The DA says their lawyers have written to eThekwini Mayor, Zandile Gumede asking her to retract the comments she is reported to have made about tomorrow's planned marches against the president.
Listen to the full bulletin below.
According to the SABC, Gumede said any protest action against Zuma amounts to treason and that police would take action against anyone taking part in the protests.
But Gumede has denied this, saying she is not stopping anyone from marching, but organisers must apply for permits.
eThekwini DA leader, Haniff Hoosen says they are expecting thousands for their march in Durban.
"It's their constitutional right to take to the streets and voice their opinions about the direction in which our country is going. We have every intention in ensuring their rights are protected. We're going to court to ensure that the mayor does not prevent the march from going ahead tomorrow. The first step in approaching any legal matter is to give notice. We've served that notice on her," he said.
Hoosen says while civil and religious organisations will be joining them, the EFF and IFP have not confirmed their attendance.

Meanwhile, Gumede says she's not stopping anyone from marching.
"What are we steering? I said every South African has the right to march. If you want to march, it's important to follow important procedures. No one can be denied the right to march," she said.
The eThekwini Metro Police say officers will be on the streets - monitoring the marches planned for the city.
