ATM writes to JSC over 'delayed' Mkhwebane ConCourt judgement

The African Transformation Movement has written to the Judicial Service Commission regarding the delayed Constitutional Court judgment on the case of suspended Public Protector Busisiwe Mkhwebane.

The party wants the JSC to provide reasons for what it says is its inconsistency.


In September, the Western Cape High Court set aside President Cyril Ramaphosa's suspension of Mkhwebane, ruling that it's unlawful.


The President and the DA both approached the Constitutional Court to overturn the lower court's decision.


The apex court heard the matter in November on an urgent basis and reserved judgement.


ATM spokesperson Zama Ntshona says the ConCourt's delay in delivering its judgement comes as a shock since the JSC recently recommended that the President suspend two High Court judges for not delivering judgments on time.


"It is disconcerting to note that the Justices of the Constitutional Court who are responsible for delivering a judgement on the Mkhwebane suspension matter have not faced any consequences for their delayed judgement despite Advocate Mkhwebane laying an official complaint with the JSC." 


A Section 194 inquiry into Mkhwebane's fitness to hold office is underway in Parliament.


Meanwhile, Friday is the deadline for the public to submit to Parliament their nominations for suitable candidates for the next Public Protector.
