ActionSA filed court papers late last year, saying it wants the court to compel the city to act.

eThekwini has insisted the problems are as as result of the floods last year.

Speaking outside the Durban City Hall on Tuesday, ActionSA's Zwakele Mncwango said the city hasn't even filed a responding affidavit to its application.

"The municipality keeps lying to the public saying this issues is around the floods only, which is not true. Only one department has responded so far and made answering affidavits.

"We must also acknowledge honesty and integrity from MEC Duma because his department didn't shy away from the truth. They made it clear that all the fault lies with the city."

The ABC is led by Philani Mavundla, who was recently ousted as deputy mayor.

Mavundla claimed the issues go back to 2015, as contained in an over a one-thousand-page damning internal document he came across while in office.

"Out of 27 wastewater works, 24 of them don't have licences, 17 have been run to total failure, two of them the auditors can't even report on them anymore because it's like they none-existence.

"Now, this is before the floods, come 2022 there is this report as well and this report is worse than the first one because, remember in April, we had the floods."
