Pistorius was found guilty last year of the culpable homicide of his girlfriend, Reeva Steenkamp and sentenced to five years behind bars.
The paralympian is due to be released on correctional supervision this Friday after serving only 10 months at the Kgosi Mampuru prison in Pretoria.
UKZN legal expert Jackie de Wet says the conditions of correctional supervision are so strict that one mistake may see him back in jail.
"He might be footed with one of the electronic ankle tracking bracelets to keep track of him - for lack of a better word. He is still in prison but it's a prison of his home. There are strict rules that he has to adhere to. With the first slip up - he goes back and serves out the rest of his sentence," he said.
The state's appeal against the nature of his conviction will be held in November.
